Who We Share Your Data With

Your personal data will be shared only where necessary and in accordance with legal and regulatory obligations:

1. Creditors and Their Representatives

We share your data with your creditors and their authorised representatives (e.g. solicitors, debt collection agents, or insolvency administrators) to negotiate and manage your IVA.

2. The Insolvency Service

Once your IVA is approved, we are required to provide your details to the Insolvency Service so that your IVA can be listed on the Individual Insolvency Register, which is publicly accessible.

3. Our Regulator

As a regulated insolvency practice, we may share information with our regulator, the Institute of Chartered Accountants in England and Wales (ICAEW), or any other supervisory authority as required by law.
This ensures we comply with professional standards and regulatory oversight.

4. IT and Software Providers

We work with trusted third-party software providers to manage and protect your data securely, including:

  • VBS – Case management system

  • Asperitas – Platform for creditor communications

  • Signable – Secure electronic document signing

All providers are contractually bound to comply with data protection laws and maintain strict security measures.

5. Other Third Parties

We may also share your information:

  • To assist law enforcement or prevent fraud

  • Where disclosure is necessary to protect the safety of individuals

If you are not eligible for services provided by AFA Insolvency Ltd, we may refer you to a trusted partner organisation. Once data is transferred, the partner becomes the data controller and their own privacy policy will apply.

  • If you become a client: We are legally required to retain your personal data for six years after we cease providing services.

  • If you do not proceed with an IVA: Your data will be deleted after 12 months, or sooner if requested.
